Jason C. Gish
Jason Gish concentrates his practice on the representation of technology based businesses. Mr. Gish counsels clients on a wide range of legal matters including technology transfer and licensing agreements, intellectual property strategies, commercial agreements and general business transactions. Mr. Gish has experience counseling clients in a variety of fields including software, software as a service, medical devices, manufacturing, e-commerce and computer hardware.
Mr. Gish possesses extensive experience from two leading law firms. Prior to forming TLG Law LLC, Mr. Gish practiced at Foley Hoag LLP and Wilmer Hale LLP, both in Boston, MA. He also clerked for the Honorable Alvin A. Schall of the U.S. Court of Appeals for the Federal Circuit.
Technology Transactions. Mr. Gish drafts and negotiates technology and intellectual property intensive agreements, including license agreements, technology development agreements, collaboration agreements, joint venture agreements, sponsored research agreements, distribution agreements, manufacturing agreements, technology and intellectual property acquisitions, patent purchase and sale agreements, patent licenses, software licenses, university licenses, on-line contracts, consulting agreements, and a variety of similar transactions. Mr. Gish participated in the creation and ongoing management of Foley Hoag LLP’s Technology Transfer & Licensing Practice Group.
Business. Mr. Gish counsels businesses on an ongoing basis with respect to general business matters. He drafts and negotiates asset and stock purchase agreements, product and service purchase and sale agreements, consulting agreements, employment agreements, confidentiality agreements, investment agreements and a variety of other business agreements. He acts as outside general counsel for businesses, advising on intellectual property and business matters, and coordinating the involvement and advice of legal specialists where appropriate.
Intellectual Property. Mr. Gish advises on intellectual property matters, including patent, copyright, trademark, and trade secret matters. He performs due diligence on acquisition and licensing targets including evaluation of intellectual property assets. He participates in the development of global patent prosecution strategies, and advises on patent non-infringement and invalidity matters. He also participates on litigation teams handling critical client litigation matters, including developing litigation strategy and preparation of briefs.
Education. Mr. Gish received his B.S. degree in Mechanical Engineering from Bucknell University, cum laude, in 1991. He received his J.D. degree from the University of Pennsylvania Law School, cum laude, in 1996.
Bar & Court Admissions. Mr. Gish is admitted to practice in the Commonwealth of Massachusetts and the District of Columbia and before the United States Court of Appeals for the Federal Circuit and the United States Patent Office.
Professional Involvement. Mr. Gish is a member of the Boston Bar Association, Licensing Executive Society, Boston Patent Law Association, and Federal Circuit Bar Association. He is currently co-chair of the Boston Chapter of the Licensing Executives Society. He is former co-chair of the Boston Bar Association’s Intellectual Property Law Section. He also presents on licensing, intellectual property and other topics at various institutions, including Massachusetts Continuing Legal Education (MCLE), the Boston Bar Association and Suffolk University Law School – Advanced Legal Studies.
